These Terms of Use (“Terms”) set forth herein govern your access to and use of thelanguagefellow.com ("The Language Fellow" or “Website”) and are a contract between you and Chandlers ('we'), with its registered office at Indore, India. ‘Service’ or ‘Services’ refers to use of one or more of the services provided on the Website including but not limited to using 'Exercise Book' or 'Exercise Books', a set(s) of questions based on a text with all associated functionality, for trial and/or by purchasing access. ‘Content’ refers to the text used in the Exercise Books and the Website. 'Content' refers to any and all text(s) contained in the Exercise Books.
Please read these Terms carefully, and contact us if you have any questions. By accessing or using the Website, you agree to be bound by these Terms and our Privacy Policy.
The website is a platform which can be used to study, practise and teach language and literature and for similar purposes, like preparing for various tests and examinations. It provides Exercise Books which you can use independently to test your grammar and practise language by doing exercises based on public domain texts and/or texts created by the people behind the Website. In The Language Fellow, teachers of language and literature may find a valuable teaching-aid in the classroom. Other uses of the Website include preparation for various tests and examinations by practising with the content of public domain texts and/or texts created by The Language Fellow and testing your knowledge of material in these texts.
Notification procedures and changes to these Terms. Chandlers reserves the right to decide on the form and means of notifying you of the changes to any and all parts of the Website, and you agree to recieve legal notices electronically if that is the way we choose to send them to you. We may revise these Terms from time to time and the most current version will always be posted on the Website. You will be notified of any revisions which are deemed material in our discretion. By continuing to access or use The Language Fellow after revisions become effective, you agree to be bound by the new Terms. If you don’t agree to the new terms, please stop using The Language Fellow.
You may use The Language Fellow only if you can legally form a binding contract with The Language Fellow, and only in compliance with these Terms and all applicable laws. When you create your account on The Language Fellow, you must provide us with accurate and complete information. You cannot use The Language Fellow if it would be prohibited by Indian laws and/or regulations. Any use or access by anyone under the age of 13 is not allowed. If you are based in the EEA, you may only use The Language Fellow if you are over the age at which you can provide consent to data processing under the laws of your country. Using The Language Fellow may include downloading software to your computer, phone, tablet, or other device. You agree that we may automatically update that software, and these Terms will apply to any updates.
You may use the Website only for lawful purposes and in accordance with these Terms. You agree not to use, or encourage, promote, facilitate, instruct, induce, or otherwise influence or cause others not to use the Website:

To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Website, or which, as determined by us, may harm The Language Fellow or its users or expose them to liability.
Additionally, you agree not to: Use the Website in any manner that could disable, overburden, damage, or impair the site or interfere with any other party’s use of the Website, including their ability to engage in real time activities through the Website. Use any robot, spider or other automatic device, process or means to access the Website for any purpose, including monitoring or copying any of the material on the Website. Use any manual process to monitor or copy any of the material on the Website or for any other unauthorized purpose without our prior written consent. Use any device, software or routine that interferes with the proper working of the Website. Introduce any viruses, trojan horses, worms, logic bombs or other material which is malicious or technologically harmful. You agree to use the Service only for purposes permitted by this Agreement, and only to the extent permitted by any applicable law, regulation, or generally accepted practice in the applicable jurisdiction. If your use of the Service or other behavior intentionally or unintentionally threatens The Language Fellow’s ability to provide the Service or other systems, The Language Fellow shall be entitled to take all reasonable steps to protect the Service and The Language Fellow’s systems, which may include suspension of your access to the Service. Repeated violations of the limitations may result in termination of your Account following which no claims concerning reinstatement, refund etc. shall be entertained by us.
A. Voluntary Termination by YouYou may delete your Account and/or stop using the Service at any time. To terminate your Account and delete your Account, contact The Language Fellow Support at support@thelanguagefellow.com. If you terminate your Account and delete your Account, you will not have access to services that require an Account on The Language Fellow. This action may be non-reversible. Any fees paid by you prior to your termination are nonrefundable (except as expressly permitted otherwise by this Agreement), including any fees paid in advance for the billing year during which you terminate. Termination of your Account shall not relieve you of any obligation to pay any accrued fees or charges.
B. Termination by The Language FellowThe Language Fellow may at any time, under certain circumstances and without prior notice, immediately terminate or suspend all or a portion of your Account and/or access to the Service. Cause for such termination shall include: (a) violations of this Agreement or any other policies or guidelines that are referenced herein and/or posted on the Service; (b) a request by you to cancel or terminate your Account; (c) a request and/or order from law enforcement, a judicial body, or other government agency; (d) where provision of the Service to you is or may become unlawful; (e) unexpected technical or security issues or problems; (f) your participation in fraudulent or illegal activities; or (g) failure to pay any fees owed by you in relation to the Service, provided that in the case of non-material breach, The Language Fellow will be permitted to terminate only after giving you 30 days’ notice and only if you have not cured the breach within such 30-day period. Any such termination or suspension shall be made by The Language Fellow in its sole discretion and The Language Fellow will not be responsible to you or any third party for any damages that may result or arise out of such termination or suspension of your Account and/or access to the Service. In addition, The Language Fellow may terminate your Account upon 30 days’ prior notice via email to the address associated with your Account if (a) your Account has been inactive for one (1) year; or (b) there is a general discontinuance of the Service or any part thereof. Notice of general discontinuance of service will be provided as set forth herein, unless it would not be reasonable to do so due to circumstances arising from legal, regulatory, or governmental action; to address user security, user privacy, or technical integrity concerns; to avoid service disruptions to other users; or due to a natural disaster, a catastrophic event, war, or other similar occurrence outside of The Language Fellow’s reasonable control. In the event of such termination, The Language Fellow will provide you with a pro rata refund of any pre-payment for your then-current paid term. The Language Fellow shall not be liable to you for any modifications to the Service or terms of service in accordance with our terms.
C. Effects of TerminationUpon termination of your Account you may lose all access to the Service and any portions thereof, including, but not limited to, your Account and Content. In addition, after a period of time, The Language Fellow will delete information and data stored in or as a part of your account(s).
LICENSING 3A. Licence to The Language Fellow ServicesLicence to Services. We grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable right to use our Services solely to
a. use the Services for trial purposes to practise, learn or teach language(s), as an aid in preparation for tests and examinations and any similar educational purpose.
b. create an Account to purchase access to the Services, after which you may use the Services to practise, learn or teach language(s), as an aid in preparation for tests and examinations and any similar educational purpose.
Your use of the Services must be in compliance with these Terms and in compliance with all applicable local, state, provincial, national and other laws, rules and regulations. In addition, by using any functionality provided by Stripe.com, you are bound by the relevant terms and policies.
3B. Restrictions on Your Licence.Without limitations on other restrictions, limitations and prohibitions that The Language Fellow imposes (in these Terms or elsewhere), you agree you will not directly or indirectly a. copy, modify, reproduce, translate, localise, port or otherwise create derivatives of any part of the Services; b. reverse engineer, disassemble, decompile or otherwise attempt to discover the source code or structure, sequence and organisation of all or any part of the Services; c. rent, lease, resell, distribute, use the Services for other commercial purposes not contemplated or otherwise exploit the Services in any unauthorised manner; d. remove or alter any proprietary notices on the Services; or (e) engage in any activity that interferes with or disrupts the Services.
3C. Our Intellectual Property and Copyrights.You agree that all Content may be protected by copyrights, trademarks, service marks, trade secrets or other intellectual property and other proprietary rights and laws. The Language Fellow may own the Content or portions of the Site Content may be made available to The Language Fellow through arrangements with third parties. Content included in or made available through the Services is the exclusive property of The Language Fellow and is protected by copyright laws. You agree to use the Content only for purposes that are permitted by these Terms and any applicable local, state, provincial, national or other law, rule or regulation. Any rights not expressly granted herein are reserved.
4A. Refund Policy Part of the service has been provided for you to use without any pre-conditions (like registration) to see if you wish to make any purchases. You are welcomed to use it appropriately and decide on whether you wish to purchase access to the rest of the Service(s). We will not be able to provide refunds on any purchase that you make on the Website. No comminication shall be entertained in this regard. In the case of dispute arising due to factors beyond our control, in no event shall any refund amount exceed that of the purchase made by you on the Website.
4B. Taxes and Third-Party FeesYou must pay any applicable taxes and third-party fees (including, for example, telephone toll charges, mobile carrier fees, ISP charges, data plan charges, credit card fees, foreign exchange fees and foreign transaction fees). We are not responsible for these fees and do not entertain queries regarding these. Please contact relevant organization or authority regarding these. We may take steps to collect the fees you owe us. You are responsible for all related collection costs and expenses. If you are located in a different country from India where our business is registered, your payments will be made to a foreign entity and applicable laws and regulations shall apply.
4C. Credit Card InformationThe payment gateways we partner with may provide you with an option to store your payment information for future use. We do not store information related to payments. Please review their relevant policies. We are not responsible nor liable for their use of your data.
We retain all intellectual property rights concerning the Content on the Website.
No part of our intellectual property and none of our trademarks or similar marks may be used without our prior written permission.
You must obtain written permission from us or under an open-source licence to modify, create derivative works of, decompile or otherwise attempt to extract source code from us.
IN NO EVENT SHALL CHANDLERS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, OR DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA OR DATA USE, INCURRED BY YOU OR ANY THIRD PARTY, WHETHER IN AN ACTION IN CONTRACT OR TORT, ARISING FROM YOUR ACCESS TO, OR USE OF, THE SITE OR ANY CONTENT PROVIDED ON OR THROUGH THE WEBSITE.
For any dispute you have with Chandlers, you agree to first contact us and try to resolve the dispute with us informally. If we need to contact you, we will do so at the email address on your The Language Fellow account.
All license agreements, use or any issues arising out of any activity regarding the use of The Language Fellow will be governed by the laws of India and subject to the exclusive jurisdiction of courts in Indore, Madhya Pradesh, India.
Our Service and all content on The Language Fellow is provided on an "as is" basis without warranty of any kind, whether express or implied.
The Language Fellow disclaims any and all responsibility for the appropriateness for a particular of any and all Content on the Website. Further, the Content does not represent and/or endorse the opinions or views of the owners and/or persons associated with The Language Fellow. In case any part of the Content on the website may be deemed to be in its nature derogatory, defamatory, discriminatory or causing intangible damages or losses of any kind, it is absolutely incidental and unintended. Any and all liability and responsibility for such damages are hereby disclaimed by us.
